1. Terms and Conditions

Contractual Relationship

These terms and conditions (“Terms”, “Agreement”) constitute a legally binding agreement between مياه أجيال, a company with its registered office at Al Malqa, Near Nahdi Pharmacy, Riyadh, Saudi Arabia (Commercial Registration Number 1010836700) (“Ajial Water”, “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement governs your use of the Ajial Water mobile application (“Ajial Application”) in Saudi Arabia.

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ACCESSING OR USING THE AJIAL APPLICATION.

If you do not agree to be bound by these terms, you may not use or access the Ajial Application. Your access and use constitute your agreement to be bound by this Agreement. Ajial Water may immediately terminate this Agreement or deny access to the application at any time for any reason without notice.

Amendments

Ajial Water may amend this Agreement from time to time. Amendments will be effective upon the posting of an updated Agreement at this location (“Location”, “website” or “Application”). Your continued access or use of the application after such posting constitutes your consent to be bound by the Agreement, as amended.

2. Accounts and Membership

  • Security: If you create an account, you are responsible for maintaining its security and are fully responsible for all activities that occur under the account.
  • Accuracy: Providing false contact information of any kind may result in the termination of your account.
  • Notification: You must immediately notify us of any unauthorized uses of your account or any other breaches of security.
  • Suspension: We may suspend, disable, or delete your account if we determine you have violated any provision of this Agreement or conducted yourself in a way that damages our reputation.

3. User Content and Privacy

  • Ownership: We do not own any data, information, or material (“Content”) that you submit in the application in the course of using the Service.
  • Eligibility: You must be at least 18 years of age to obtain an account.
  • Account Info: Registration requires personal information such as name, address, mobile phone number, gender, and age.
  • Data Usage: You grant us permission to access, copy, distribute, and store your account content solely as required for the purpose of providing the Services to you.
  • Data Deletion: Ajial Water will destroy the user’s personal data within 90 days of receiving a deletion request.

4. Cancellation and Refund Policy

If the User wishes to cancel an order, they must submit a cancellation request at least 24 hours in advance of the mentioned delivery date.

  • Refund Process: Approved refunds take no less than three business days.
  • Refund Method: Amounts will be returned to the User’s electronic wallet and then transferred to their bank account.
  • Timelines:
    • Mada cards: 24–72 business hours.
    • Credit Cards: Up to 21 days.

5. Prohibited Uses

You are prohibited from using the Ajial Application or its content for:

  • Any unlawful purpose or to solicit others to perform unlawful acts.
  • Violating any international, federal, or local regulations, rules, and laws.
  • Infringing upon our intellectual property rights or the rights of others.
  • Harassing, abusing, insulting, or discriminating based on gender, religion, race, age, or disability.
  • Uploading or transmitting viruses or any other type of malicious code.
  • Collecting or tracking the personal information of others.
  • Interfering with or circumventing the security features of the Service or any related application.

6. Intellectual Property Rights

This Agreement does not transfer to you any intellectual property owned by Ajial Water or third parties. All rights, titles, and interests in and to such property will remain solely with Ajial Water. All trademarks, service marks, graphics and logos used in connection with the Ajial Application or Services are trademarks or registered trademarks of Ajial Water or its licensors.

Subject to your compliance with this Agreement, Ajial Water grants you a limited, non-exclusive, non-sub-licensable, revocable, non-transferable license to access and use the Ajial Application on your personal device solely for your personal, non-commercial use. Any rights not expressly granted herein are reserved by Ajial Water.

7. Collection and Use of Personal Data

At Ajial Water, we place great importance on protecting the privacy of personal data and are committed to maintaining the confidentiality of such information.

  • Data Collection: We collect and use personal data provided by the user with their consent, to create an account via the application or website to access our services.
  • Types of Data: The data we may collect includes name, phone number, address, gender, date of birth, and payment information.
  • Security Commitment: Ajial Water is committed to safeguarding credit data against unauthorized use, misuse, or access by unauthorized parties.
  • Retention Period: Personal data will be retained only for as long as necessary to fulfill the purposes stated in these Terms and Conditions or to comply with legal and regulatory requirements.

Purpose of Data Collection:

  1. To create and manage user accounts and provide services.
  2. To process financial transactions.
  3. To send notifications and updates related to the user’s account and our services.
  4. To communicate regarding services offered or to handle inquiries and complaints.
  5. To analyze and continuously improve performance to ensure the best user experience.
  6. To provide personalized offers to the user.
  7. Promoting products or services, provided the user has given explicit consent.

Data Subject Rights

  • Right to Know: The user has the right to know the purpose of data collection, how their data is used, and to access their personal data.
  • Access and Correction: Users may request access to, correction, updating, or deletion of their personal data.
  • Withdrawal of Consent: Users may withdraw their consent when the data is no longer needed.
  • Data Destruction: Ajial Water will destroy the user’s personal data within 90 days of receiving a deletion request.

Data Sharing

Ajial Water may share personal data with third parties such as complaint processors, insurance companies in case of disputes, regulatory or security authorities, or service providers assisting in operating the services. This sharing is based on legitimate interest and for specific purposes.

Consent for Promotional Communications

  • Submission Consent: By submitting personal data through the app, you express consent to our collection, use, and disclosure of your information as described.
  • Promotional Material: You consent to receiving promotional offers via phone calls, SMS, and email.
  • Opt-Out: You may opt out at any time by disabling promotional notifications through the app or by contacting customer service.

8. Promotions Terms

Promotions from Ajial Water are subject to the following terms and conditions:

  1. Only one promotion or discount offer may be applied per order unless explicitly stated otherwise.
  2. Promotions may be applied automatically or may require a promo code, depending on the specific offer.
  3. Promotions are valid through the Ajial Water mobile application, the official website, and the Ajial Water call center.
  4. Most promotions are announced through official Ajial Water accounts, the app, or the website, though some may appear on third-party platforms.
  5. Certain items may be excluded from specific promotions, which will be clearly stated in the offer details.
  6. Loyalty points earned via Ajial Water or approved second-party programs may be merged with select promotions, subject to applicable terms.
  7. Ajial Water reserves the right to modify, extend, or terminate promotions at any time without prior notice.
  8. If an order is canceled or returned, any promotional products received as part of the offer must also be returned.
  9. Additional terms specific to each individual promotion may apply and are considered part of these overarching terms.

9. Limitation of Liability

  • Excluded Damages: To the fullest extent permitted by law, Ajial Water and its affiliates will not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, revenue, or business opportunity.
  • Aggregate Limit: The maximum aggregate liability of Ajial Water relating to the services will be limited to the greater of one dollar or the amount actually paid in cash by you to Ajial Water for the one-month period prior to the event giving rise to such liability.
  • Account Security: Ajial Water expressly disclaims liability arising from the unauthorized use of your User account. Should you suspect any unauthorized party may be using your account, you agree to notify us immediately.

10. Indemnification

You agree to indemnify and hold Ajial Water and its affiliates, directors, officers, employees, and agents harmless from any liabilities, losses, damages, or costs (including reasonable attorneys’ fees) arising from third-party claims related to your Content, your use of the Application, or any willful misconduct on your part.

11. Dispute Resolution

  • Governing Law: The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Saudi Arabia.
  • Jurisdiction: The exclusive jurisdiction and venue for legal actions related to this subject matter shall be the courts located in Riyadh, Saudi Arabia.

12. General Provisions

  • Pricing: Product prices on the product page are rounded to two decimal digits, but the actual order total is calculated using four decimal digits.
  • Assignment: You may not transfer your rights under this Agreement without prior written approval; however, Ajial Water may assign its rights to an affiliate or successor.
  • Relationship: No joint venture, partnership, or employment relationship exists between you and Ajial Water as a result of this Agreement.
  • Severability: If any provision is held to be illegal or unenforceable, the remaining portions of the Agreement shall remain in full force and effect.

13. Changes to the Terms of the Agreement

Ajial Water reserves the right to update this Agreement and its core terms from time to time in accordance with changes in laws and regulations or to enhance our services. In the event of any material changes, we will notify you via an in-app notification or by email. Your continued use of our services following such modifications constitutes your acceptance of the amended terms.
